Terms and Conditions of Service
Effective August 24, 2026. These Terms apply to all divisions and business units of At Your Service Pros, including HVAC service and installation, plumbing, electrical, warranty services, commercial installation, and Healthy Water and Air.

1. Agreement
These Terms and Conditions ("Terms") are incorporated by reference into every estimate, work order, and invoice issued by At Your Service Pros and its affiliated business units ("Company," "we," "us"). By signing an estimate or invoice, approving work in writing or verbally, or permitting work to proceed, the customer ("you") agrees to these Terms. If a signed estimate or invoice expressly conflicts with these Terms, the signed document controls for that job.
2. Estimates and Pricing
We price work on a flat-rate basis: the price presented is the total price for the work described, regardless of the time required to complete it. Estimates are valid for 30 days from the date of issue unless otherwise stated. An estimate covers only the work described on its face. Diagnostic and dispatch fees are disclosed at the time of booking and are earned upon completion of the diagnostic visit, whether or not you proceed with recommended repairs.
3. Change Orders and Concealed Conditions
If concealed or unforeseen conditions are discovered after work begins (including hidden damage, deteriorated or non-code-compliant existing systems, non-standard construction, or hazardous materials), we will stop, explain the condition, and obtain your approval of a change order before performing additional work at additional cost. Work made necessary by conditions we could not reasonably have discovered before starting is not included in the original price.
4. Payment
Unless prior arrangements for billing have been made, payment for all work is due in full upon completion (C.O.D.). A $10.00 billing charge is due thereafter. An office billing charge and/or finance charge of 1.75% per month (21% per annum), minimum charge $15.00, will be added after 10 days past due. If your check does not clear, you are liable for the amount of the check, any charges imposed by the bank, and a $25.00 returned check fee. A non-refundable processing fee of 3% of the transaction total applies to payments over $10,000.00; this fee does not apply to cash, check, ACH/bank transfer, or financing. We may decline to perform warranty or other service while an account is past due. Equipment and materials remain our property until paid for in full, and we retain all rights available under Utah lien law.
5. Financing
Financing, when offered, is provided by third-party lenders, subject to their credit approval and governed by your separate agreement with the lender. We are not a lender and do not set financing terms, rates, or approval decisions.
6. Collections
If collection efforts become necessary, you agree to pay all associated fees at the posted rates, together with all costs of collection, reasonable attorney's fees, and court costs.
7. Permits, Inspections, and Code Compliance
Where work requires a permit, the permit is obtained at your cost. Permit fees are charged at the amount set by the issuing authority and are not subject to membership or any other discount. Inspection scheduling is controlled by the authority having jurisdiction, and we are not responsible for its delays. Unless expressly included in the estimate, our price does not include correcting pre-existing code violations or upgrades required by code outside the described scope of work.
8. Scheduling and Delays
We will perform the work within a reasonable time. We are not responsible for delays caused by events beyond our control, including weather, supplier or material shortages, shipping delays, labor disruptions, utility failures, or permit and inspection delays.
9. Materials and Substitutions
If specified equipment or materials become unavailable, we may substitute items of comparable or better quality and specification. Excess materials remain our property. Risk of loss for equipment delivered to the job site but not yet installed remains with us except where loss results from your negligence or from theft or vandalism at an unsecured site.
10. Warranties
Labor. Unless a different period is stated on your invoice, we warrant our workmanship for one (1) year from the date of completion.
Parts and equipment. Parts and equipment carry the manufacturer's warranty only. Where noted, we will assist with warranty registration; registration deadlines (commonly 90 days) may apply, and completing registration is your responsibility.
Membership. Service Partner Plan members receive enhanced warranty benefits as described in the current plan brochure, while the membership remains active and our maintenance recommendations are followed.
Drain work. Drain cleaning and stoppage clearing are warranted for 30 days only, and recurring stoppages caused by root intrusion, pipe condition, or items introduced into the line are not covered.
Exclusions. Warranties do not cover: damage from misuse, neglect, or lack of required maintenance; alterations or repairs by others; consumable items such as filters; pre-existing conditions; equipment or components we did not install or service (including existing line sets, gas piping, ductwork, wiring, and venting); or damage from causes beyond our control, including freezing, flood, lightning, fire, and electrical power surges. All warranties are conditioned on payment in full.
11. Existing Systems and Performance
We are not responsible for the condition, capacity, or performance of existing equipment, piping, wiring, ductwork, or venting that we did not install, or for the compatibility of new equipment with existing components you elect not to replace. Equipment efficiency ratings are manufacturer figures; actual utility usage and savings depend on conditions we do not control, and we do not guarantee energy savings. Utility rebates and manufacturer incentives, where available, are subject to the issuing program's rules and approval, and are not guaranteed by us.
12. Mold and Hazardous Materials
We do not test for, remove, or remediate mold, asbestos, lead, or other hazardous materials. If such materials are discovered, we may suspend work until the condition is professionally remediated at your cost, and we assume no responsibility for their presence, disturbance discovered in the course of work, or related claims.
13. Satisfaction Guarantee
Customer service is our number one focus. If you are not completely satisfied with our work for any reason, contact our office and ask to speak with a manager, and we will work with you to make it right.
14. Old Parts and Disposal
All old parts and replaced equipment will be removed from the premises and discarded unless you request otherwise before work begins, or the signed document states otherwise.
15. Customer Responsibilities; Work Area
You agree to provide safe and reasonable access to work areas, secure pets, ensure an adult (18 or older) is present during work in an occupied home, and disclose known hazards or conditions relevant to the work. Please remove valuables and fragile items from work areas; we are not responsible for personal property left in the work area. If unsafe conditions prevent work from proceeding, we may suspend work and charge for time and materials expended.
16. Work Not Included
Unless expressly stated in the estimate or invoice, our price does not include: drywall, plaster, paint, tile, flooring, or other finish repairs; landscaping, sprinkler, or concrete restoration; or repair of concealed piping, ductwork, or wiring beyond the described work. Cutting and penetration of finished surfaces reasonably necessary to perform the work is your responsibility to refinish.
17. Subcontractors
We may use qualified, licensed subcontractors for portions of the work. Our warranties and these Terms apply to subcontracted work the same as work performed by our own technicians.
18. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including lost profits, loss of use, mold, or water damage arising from pre-existing conditions, and our total liability for any claim arising out of the work shall not exceed the amount you paid for the work giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
19. Cancellation
You may cancel or reschedule non-emergency work without charge by giving at least 24 hours' notice. For certain sales made at your residence, you may have a right under applicable law to cancel within three business days; contact our office to exercise any such right. If you cancel an equipment order after special-order materials have been purchased, you are responsible for actual restocking and return costs.
20. Service Partner Plan
Membership discounts (15% off qualifying repairs; 5% off replacements and equipment) apply only while the membership is active and do not apply to permits or other pass-through fees. Membership benefits, pricing, and commitment periods are described in the current Service Partner Plan brochure, which governs the membership.
21. Communications and Documentation
By providing your phone number and email you consent to receive appointment, dispatch, and billing communications by call, text, and email; message and data rates may apply, and you may opt out of non-essential messages at any time. We may photograph work areas before, during, and after the job to document conditions, work quality, and warranty matters; we will not publish photographs identifying your home or person for marketing purposes without your permission.
22. General
These Terms are governed by the laws of the State of Utah, and any dispute shall be brought in the courts of Utah County, Utah. If any provision is held unenforceable, the remainder of these Terms remains in effect. These Terms, together with the signed estimate, work order, or invoice, constitute the entire agreement for the work; modifications must be in writing. Our failure to enforce any provision is not a waiver of it. We are licensed and insured; license information is available upon request.
23. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes indicates your acceptance of the updated Terms. For material changes, we will provide notice.
24. Dispute Resolution
Communication. If you have a complaint or dispute, please contact us immediately at (801) 407-9320 or office@yourservicepros.us. We are committed to resolving issues promptly.
Mediation. Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes may proceed to mediation before legal action.
